Nebraska Law Review Highlights Rural School Finance Issues
Publication Fills Important Gap in Legal Scholarship on Rural Equity and Adequacy

The legal issues surrounding rural school finance are the subject of a new collection of scholarly articles in the latest edition of the Nebraska Law Review, published by the University of Nebraska College of Law in Lincoln. The journal fills a big gap in scholarship, according to the Rural School and Community Trust (Rural Trust), a national nonprofit organization focused on rural education. By addressing school finance law as it relates to rural education and discussing leading rural school finance issues that have been or are likely to be litigated, the journal will help courts sort out the increasingly complex issues that surround how to fund the nation's small and rural schools.

Publication of the law review is significant and timely. Nearly one-third of the nation's children attend school in rural places, and small rural schools often serve large geographic areas, many of them economically distressed. Since the early 1970s, state court litigation has been brought in 46 of the 50 states to ensure equitable and adequate funding for education, and most of the recent cases have had their origins in rural states-or in the rural areas of larger states. Most recently, Nebraska has joined the list of states with pending finance litigation, with a finance suit filed by the Omaha Public Schools. In a number of states, court decisions have pressured state legislatures to make major changes in funding for education.
